Assisting our clients in understanding their responsibilities, rights and duties under a policy of insurance is a major area of our practice. We have handled a broad variety of insurance cases before trial courts, and appellate courts in Virginia and the District of Columbia. These include analysis of homeowners policies, automobile policies, CGL policies, and builders risk policies. In addition to actively litigating insurance related issues, partners in the firm have been involved in providing continuing legal education classes on insurance law to members of the bar, as well as co-authoring a chapter in the Virginia Continuing Legal Education book on Virginia Insurance Law. The firm can assist in providing opinions as to whether a claim is covered under the policy, whether the insurance company has an obligation to provide a defense or indemnify. The firm can assist in the filing of a declaratory judgment action and defense of bad faith claims. The firm has been selected as one of a handful of select firms for major insurance companies to handle extra-contractual liability cases, and "bad faith" claims.

 Interpretation of insurance policies to determine duties of defense and indemnification requires specialized knowledge of the law applicable to contract interpretation, interpretation of insurance policies, and the burdens of proof of the respective parties. Based upon review of underlying claim material and the applicable policy, the attorneys evaluate claims, demands for coverage, and the duty to defend, providing a detailed and legal analysis of all issues. A proper analysis at the beginning of the claims process is critical to avoiding claims of bad faith or breach of contract and to successfully defeating such claims if a denial of coverage is challenged. The firm is uniquely qualified to provide analysis and counsel throughout the claims evaluation process and at trial.
