The attorneys of MBBTK have experience handling libel, slander, and defamation lawsuits in federal and state courts in the District of Columbia and the Commonwealth of Virginia. We identify claims that can be disposed early in the litigation process and resolve them quickly. In defending these claims, we focus on the protection speech receives under the Constitution, as well as statutory and common law. By focusing on early dismissal of defamation lawsuits, we endeavor to provide our clients with positive results through a cost-effective approach.

Our attorneys have succeeded in this approach to defamation in several reported cases including, Wolf v. Fauquier County Board of Supervisors, 555 F.3d 311 (4th Cir. 2009) and Gibson v. Boy Scouts of America, 163 Fed. Appx. 206 (4th Cir. 2006), both of which were successfully argued by members of the firm before the United States Court of Appeals for the Fourth Circuit, and resulted in dismissal of the defamation claims. We have also obtained pre-trial dismissal of defamation claims in trial courts in the federal and state systems.

For those claims that must go to trial, our experienced trial attorneys aggressively investigate the truth of allegedly defamatory statements and the harm allegedly caused. In this manner, we can present a strong case that the alleged statements were not defamatory and control the damages a jury may assess.

McGavin, Boyce, Bardot, Thorsen, and Katz, P.C., handles civil and business litigation defense, insurance law and defense, government and municipal law, and workers' compensation, cases throughout the Commonwealth of Virginia, Maryland, and in the District of Columbia and DUI/traffic defense cases in Virginia.
